CFTC gives exchanges 30 days to end geographic access restrictions

The Commodity Futures Trading Commission has ordered US derivatives exchanges to remove domestic geographic access restrictions within 30 days, or explain to the regulator why they cannot comply. The interpretation of the Commission’s Impartial Access Requirements was issued on 5 November 2026 and sets a hard deadline of early December for designated contract markets (DCMs) to act.

In its announcement, the Commission said the requirement under Regulation 38.151(b) that DCMs “provide competitive, open, fair, and impartial access to their members and persons with trading privileges” had been clarified, and that exchanges must “cease domestic geographic restrictions that violate the Impartial Access Requirements within 30 days, or else submit to the Division of Market Oversight an explanation for why such compliance is not feasible.” The CFTC’s press release states that DCMs must also ensure intermediaries accessing their markets are not impeding impartial access, within the same 30-day window.

Chairman Michael S. Selig put the reasoning in plain terms in the release: “Derivatives markets must operate on a uniform basis at a national scale in order to achieve the purposes set out in the Commodity Exchange Act.” He added that “geographic access restrictions are inconsistent with those purposes and the Act’s impartial access requirements.” The Commission will weigh the facts of any particular case before considering action.

Why traders should care

The interpretation is an escalation of the CFTC’s push to assert national-scale authority over derivatives markets, and it lands squarely on prediction-market platforms that have built state-level blocks into their access rules. It comes days after the CFTC sued Utah on 28 October to block state enforcement against prediction markets, and three days after Sporttrade was granted approval as a DCM and clearing organisation on 2 November. The interpretation does not name any exchange, state or platform, and the agency has not said whether it changes the litigation posture in Utah or Nevada.

For traders, the practical question is whether event contracts and other derivatives soon become available without state-by-state access limits, or whether the CFTC’s federal framework runs into the same resistance from state regulators that courts have already shown. The Commission has proposed federal oversight of crypto exchanges through new Regulation CTX and CAM frameworks, and analysts have warned that its crypto rules may not survive past the 2028 election, so the durability of this stance is itself an open question.

Compliance or an explanation is due to the Division of Market Oversight 30 days from 5 November, putting the deadline in the first week of December.
